Open Internet: What’s at Stake?
The FCC released the Open Internet Order in December 2010 adopting anti-blocking and anti-discrimination rules, as well as  rules requiring broadband providers to disclose their network management practices.  In January 2014, the U.S. Court of Appeals for the District of Columbia Circuit affirmed the FCC’s authority under Section 706 to regulate broadband Internet access service, but vacated the anti-blocking and anti-discrimination rules on the grounds that the FCC could not apply common carrier regulation to information services.   In response to the Court’s remand, the FCC proposed revised Open Internet rules in May, which remain a hot button topic, with more than  1 million comments filed at the FCC.  This session will look at what should be done to ensure that the Internet remains open and free and that consumers are able to access any point on the Internet without interference from their ISPs, as well as what regulatory scheme would be most beneficial to all interested parties.
